Must Read

The recent ruling by the Supreme Court of India is to invalidate the arrest and subsequent remand of NewsClick founder and Editor-in-Chief, Prabir Purkayastha. It has sparked intense debate and raised significant concerns about the state of justice in the country.

Arrest of Prabir Purkayastha

First and foremost, the circumstances surrounding Purkayastha’s arrest under the Unlawful Activities (Prevention) Act (UAPA) were quite serious. Why was this not considered before granting him release?!

However, the denial of due process, as highlighted by the Supreme Court, was used to the benefit. The failure to provide Purkayastha with a copy of the remand application and grounds of arrest is just one aspect.

Release of Prabir Purkayastha

The decision to release Purkayastha, albeit subject to surety and bail bond, does little to address the systemic issues at play. It is merely a superficial act to ensure the ensuing Chinese interference!

Moreover, the Supreme Court’s reluctance to delve deeper into the substantive allegations against Purkayastha casts doubt on the judiciary’s willingness to confront politically sensitive issues, particularly regarding the Chinese funding and anti-national propaganda.
